Unauthorised use, reproduction, or distribution is strictly prohibited and may result in civil and criminal liability.

Ownership of Intellectual Property

Beauty Garage Limited (CIN: U20237MH2021PLC354428) is the owner or authorised licensee of all intellectual property rights in and to the following:

Brand and trade marks: the name “Beauty Garage”, the “Beauty Garage Professional” mark, all associated logos, monograms, wordmarks, device marks, and trade dress, whether registered or unregistered, used in connection with our products and services.
Product names and sub-brands: all product line names, series names, collection names, and product-specific names used on our products and Platform, including but not limited to Botoliss, K9 Botoplexx, Shea Microfuel, and any other current or future sub-brands.
Product formulations: the formulations, processes, and proprietary blends developed by our research and development team are confidential trade secrets and proprietary information of Beauty Garage Limited.
Website and platform content: all text, articles, blog posts, how-to guides, ingredient guides, hair care tips, and other written content published on beautygarage.com or our associated platforms.
Visual and creative assets: all photographs, product images, lifestyle images, illustrations, graphics, icons, animations, videos, reels, and audiovisual content created for or on behalf of Beauty Garage Limited.
Software and technology: the source code, design, architecture, and functionality of beautygarage.com and our associated mobile applications.
Marketing and advertising material: all advertising copy, campaign creative, packaging design, label design, and promotional material produced by or for Beauty Garage Limited.
Training and educational content: all salon training materials, professional education content, product knowledge guides, and certification programmes developed by Beauty Garage Limited.

Copyright Notice

All content on beautygarage.com and on our associated social media channels and digital properties is protected by copyright under the Copyright Act, 1957 (India) and applicable international copyright conventions, including the Berne Convention for the Protection of Literary and Artistic Works.

Copyright in all original content created by or for Beauty Garage Limited vests in Beauty Garage Limited from the date of creation. No content on the Platform may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or otherwise used in any form or by any means, electronic or mechanical, without the prior written consent of Beauty Garage Limited, except as expressly permitted under this Notice or by applicable law.

Trade Marks

The name “Beauty Garage” and all associated logos and product names are registered or pending trade marks of Beauty Garage Limited in India, filed with the Office of the Controller General of Patents, Designs and Trade Marks under the Trade Marks Act, 1999. All rights in these marks are reserved.

The ® symbol indicates a registered trade mark. The ™ symbol indicates a trade mark for which registration has been applied for or which is claimed as an unregistered trade mark. The use of either symbol on the Platform or on our product packaging constitutes notice of our trade mark rights.

Third-party trade marks, brand names, and logos that may appear on the Platform are the property of their respective owners and are referenced solely for descriptive or compatibility purposes. Their appearance on the Platform does not imply any affiliation with, endorsement by, or sponsorship of Beauty Garage Limited.

What you may not do with our trade marks

You must not use any Beauty Garage trade mark or logo in any of the following ways without our prior written consent:

As part of your own brand name, company name, product name, or domain name.
In a manner that suggests affiliation with, endorsement by, or sponsorship by Beauty Garage Limited.
In connection with products or services that are not ours.
In any way that is likely to cause confusion among consumers or that disparages or discredits Beauty Garage Limited.
As a keyword in paid search advertising without our prior written consent.

Permitted Use

Notwithstanding the restrictions set out in this Notice, the following limited uses are permitted without our prior written consent:

Personal, non-commercial use: you may view, print, and download content from the Platform solely for your own personal, non-commercial reference, provided you do not modify the content and retain all copyright and other proprietary notices.
Fair dealing: use of our content for the purposes of criticism, review, reporting of current events, research, or private study, as permitted under Section 52 of the Copyright Act, 1957, provided that such use is accompanied by a clear and prominent acknowledgement of the source.
Sharing on social media: sharing individual product pages or Platform content via the social sharing functions provided on the Platform is permitted, provided the content is not altered and is shared with a direct link to the original page on beautygarage.com.

All other uses require our prior written consent. When in doubt, please contact us at the address provided below before reproducing or using any content from the Platform.

Prohibited Uses

The following uses of our intellectual property are strictly prohibited:

Reproducing, copying, or republishing any content from the Platform on another website, blog, social media account, or digital platform without our prior written consent.
Creating derivative works, adaptations, or translations of any content from the Platform without our prior written consent.
Using our product images, photographs, or videos in any commercial context, including advertising, influencer content, affiliate marketing, or sponsored posts, without a written licence from us.
Framing or mirroring any part of the Platform on another website without our express written consent.
Using our trade marks, logos, or brand elements in any manner not expressly permitted under this Notice.
Scraping, crawling, or systematically extracting content from the Platform using automated tools.
Reproducing our product formulations, packaging designs, or trade secrets in any form.
Creating or distributing counterfeit products bearing our trade marks, product names, or packaging.

Unauthorised use of our intellectual property may constitute trade mark infringement under the Trade Marks Act, 1999, copyright infringement under the Copyright Act, 1957, passing off, and unfair competition under common law, and may expose you to civil and criminal liability including injunctions, damages, account of profits, delivery up, and prosecution.

User-Generated Content and Licence

When you submit reviews, ratings, photographs, videos, comments, or any other content to the Platform or tag us on social media, you confirm that you are the sole author and owner of the content, or have obtained all necessary rights and permissions from the owner; the content does not infringe the intellectual property, privacy, or other rights of any third party; and you grant Beauty Garage Limited a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, sublicensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform such content in any media format, now known or hereafter developed, for any purpose including marketing, advertising, and product development, without further consent or compensation.

We may credit you when using your content at our discretion but are under no obligation to do so. We reserve the right to remove any user-generated content from the Platform at any time and for any reason, without notice.

If you believe that any user-generated content on our Platform infringes your intellectual property rights, please notify us using the contact details in the Infringement Notification section below.

Infringement Notification

If you believe that any content on the Platform infringes your copyright, trade mark, or other intellectual property rights, please send a written notice to our designated contact with the following information:

Your full name and contact details (name, address, email address, and phone number).
A description of the intellectual property right you claim has been infringed and, where applicable, the registration number.
A description of the content on the Platform that you claim infringes your rights, with sufficient detail for us to locate it (such as a URL).

Third-Party Intellectual Property

The Platform may contain references to, or links to, content owned by third parties. All third-party intellectual property appearing on the Platform remains the property of its respective owners. Nothing on the Platform should be construed as granting any licence or right to use any third-party intellectual property without the express written permission of the relevant owner.

Any person who obtains access to our confidential information through employment, a business relationship, or any other means is bound by an obligation of confidentiality and must not disclose, reproduce, or use such information without our express written authorisation.

Licensing and Permissions

All requests for licences to use our intellectual property, including requests to use our trade marks in press or editorial content, to reproduce our product images for affiliate or review purposes, to feature our products in commercial productions, or to use our content for educational or training purposes, should be directed to:

Enforcement

We actively monitor the use of our intellectual property and take infringement seriously. We reserve all rights to enforce our intellectual property rights to the fullest extent of applicable law, including by seeking injunctions, damages, an account of profits, delivery up of infringing material, and where appropriate, criminal prosecution under the Trade Marks Act, 1999 and the Copyright Act, 1957.

We also actively monitor online marketplaces, social media platforms, and third-party websites for unauthorised use of our brand, trade marks, and content, and will take action against infringers including reporting to platform operators and initiating legal proceedings where warranted.

Changes to This Notice

We may update this Notice from time to time to reflect changes in our intellectual property portfolio, applicable law, or enforcement approach.

Governing Law and Jurisdiction

This Notice is governed by the laws of India. Any dispute arising from or in connection with this Notice, including claims of infringement, shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. Notwithstanding this, we reserve the right to seek injunctive or other equitable relief in any jurisdiction as we deem appropriate to protect our intellectual property rights.
