These Terms and Conditions ("Terms") govern your access to and use of the website beautygarage.com and all associated mobile applications, portals, and services (together, the "Platform") operated by Beauty Garage Limited ("BGL", "we", "us", "our"). By accessing or using the Platform, placing an order, or creating an account, you agree to be bound by these Terms and all policies referenced herein. If you do not agree, please do not use the Platform.

Beauty Garage Limited is an inventory-led manufacturer and seller of professional hair care products and accessories. We sell directly to consumers via beautygarage.com (D2C) and to trade partners including salons and distributors (B2B). We are not a marketplace or aggregator.

Applicability and Acceptance
These Terms apply to all users of the Platform, including:

Individual consumers purchasing products for personal use (D2C customers).

Business buyers, salons, distributors, and professional purchasers (B2B partners).

Visitors who browse the Platform without registering or purchasing.

By using the Platform, you confirm that you are at least 18 years of age (or have the consent of a parent or legal guardian), are legally competent to enter into a binding contract under the Indian Contract Act, 1872, and have read and agreed to these Terms. Use of the Platform by anyone below 18 without parental consent is not permitted.

These Terms should be read alongside our Privacy Policy, Cookie Policy, Return and Refund Policy, Cancellation Policy, Shipping and Delivery Policy, and any other policies published on the Platform, all of which form part of the agreement between you and Beauty Garage Limited.

Account Registration
Certain features of the Platform, including placing orders and tracking shipments, require you to create an account. When registering, you agree to:

Provide accurate, current, and complete information.

Keep your account credentials confidential and not share them with any third party.

Notify us immediately at help@beautygarage.com if you suspect any unauthorised access to your account.

Accept responsibility for all activities that occur under your account.

Beauty Garage Limited reserves the right to suspend or permanently terminate any account if we have reason to believe that the information provided is inaccurate, that the account is being used fraudulently or in breach of these Terms, or for any other reason at our discretion.

Products, Pricing, and Availability
Product information
We endeavour to display accurate product descriptions, images, ingredient lists, and specifications on the Platform. However, the physical product packaging and labelling remain the authoritative source of information. Minor variations in colour or appearance between images and the actual product may occur due to photography and screen settings.

Pricing
All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes (GST) unless otherwise stated. Beauty Garage Limited reserves the right to revise prices at any time without prior notice. The price applicable to your order is the price confirmed at the time of placing the order. Beauty Garage Limited shall not be liable for any pricing errors and reserves the right to cancel orders placed at an incorrect price, notifying you and issuing a full refund.

Availability
Product availability is subject to stock levels and may change without notice. In the event that a product becomes unavailable after your order is placed, we will notify you and offer a refund, an alternative product, or a delayed shipment, at your option.

Promotional offers and discounts
Promotional offers, discount codes, and sale prices are valid only for the period and on the terms specified at the time of the promotion. Offers cannot be combined unless expressly stated. Beauty Garage Limited reserves the right to withdraw or modify any promotion at any time without prior notice.

Placing an Order
By placing an order on the Platform, you make an offer to purchase the selected products at the displayed price and on the terms described. An order confirmation sent to your registered email or phone number acknowledges receipt of your order but does not constitute acceptance. A binding contract is formed when Beauty Garage Limited dispatches your order and sends a shipment confirmation.

Beauty Garage Limited reserves the right to refuse or cancel any order at any time for reasons including (but not limited to): product unavailability, pricing errors, suspected fraudulent activity, or failure of payment authorisation. In such cases, any amount already charged will be refunded in full.

For B2B orders, additional terms including minimum order quantities, credit terms, and lead times may apply as set out in the relevant purchase order or B2B agreement.

Payment
We accept payment by credit card, debit card, net banking, UPI, and digital wallets through our authorised payment gateway partners. All transactions are processed in INR. We do not store your full card details or CVV.

Payment is due at the time of placing an order (prepaid) or at the time of delivery for Cash on Delivery (COD) orders where available. COD is subject to order value limits and delivery location eligibility as displayed at checkout.

If a payment fails or is declined, your order will not be confirmed. Beauty Garage Limited is not liable for any charges imposed by your bank or payment provider in connection with a failed or declined transaction.

We will never ask for your OTP, full card number, CVV, or PIN through any channel. Please report any such request to help@beautygarage.com immediately.

Shipping and Delivery
We deliver orders across India through our logistics partners. Estimated delivery timelines are displayed at checkout and in your order confirmation. These are estimates and not guarantees; actual delivery may vary depending on your location, product availability, and circumstances beyond our control including weather events, strikes, and logistics disruptions.

Beauty Garage Limited is not responsible for delays caused by incorrect or incomplete delivery addresses provided by you. If a delivery attempt fails due to absence or inaccessibility, our courier partner will make subsequent attempts or leave a delivery notice. Undelivered parcels may be returned to us, in which case we will contact you to arrange re-delivery (which may incur an additional shipping charge) or issue a refund.

Returns, Refunds, and Cancellations
Returns
We accept returns only where a product is received in a damaged, defective, or incorrect condition. Return requests must be raised within 24 hours of delivery by contacting help@beautygarage.com with your order ID, reason, and an unboxing video (mandatory). Products must be returned in original condition with all seals, labels, barcodes, accessories, and packaging intact.

The following are not eligible for return: used or opened products; products with tampered or missing seals or warranty labels; trial packs; customised or made-to-order kits; personal care appliances that have been used; items purchased under special promotions (unless received damaged or defective); and return requests raised after 24 hours of delivery.

Refunds
Refunds are processed after the returned item is received and passes our quality check. Timelines are as follows:

Prepaid orders (card, UPI, net banking, wallet): refund to the original payment source within 7 to 10 working days of QC clearance.

COD orders: refund via bank transfer or UPI within 10 to 15 business days after receipt of your bank details.

Cancellations
Orders may be cancelled only before they are dispatched. Once an order has been shipped, it cannot be cancelled; you may instead initiate a return after delivery (subject to our Returns Policy). To cancel a pre-shipment order, contact us at help@beautygarage.com or via the Platform. Refunds for cancelled prepaid orders are initiated within 24 to 48 business hours of confirmation.

Acceptable Use
You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Platform. You must not:

Use the Platform for any fraudulent, unlawful, or abusive purpose.

Post, upload, or transmit content that is defamatory, obscene, hateful, misleading, or infringes any third-party intellectual property rights.

Attempt to gain unauthorised access to any part of the Platform, its servers, or any systems or networks connected to the Platform.

Use automated tools (bots, scrapers, crawlers) to access, copy, or monitor the Platform without our prior written consent.

Engage in any activity that interferes with or disrupts the Platform or its infrastructure.

Resell products purchased on the Platform without Beauty Garage Limited's prior written authorisation (applicable to D2C purchases).

Beauty Garage Limited reserves the right to suspend or terminate your access to the Platform and take appropriate legal action if you breach these provisions.

User-Generated Content
If you submit reviews, ratings, images, videos, comments, or other content to the Platform ("User Content"), you confirm that:

The content is your own original work and you have the right to submit it.

The content is accurate and not misleading, defamatory, obscene, unlawful, or harmful.

The content does not infringe any third-party intellectual property, privacy, or other rights.

By submitting User Content, you grant Beauty Garage Limited a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify, publish, translate, and display such content across any media for marketing and operational purposes.

Beauty Garage Limited may moderate, remove, or decline to publish User Content that violates these Terms or is otherwise inappropriate, without notice. To request deletion of content you have submitted, write to help@beautygarage.com with your name, registered email, the URL or description of the content, and your reason for the request. We will process reasonable requests in a timely manner.
Intellectual Property
The name "Beauty Garage", associated logos, product names, trade dress, graphics, images, product formulations, and all content on the Platform are the intellectual property of Beauty Garage Limited or its licensors, protected under the Trade Marks Act, 1999, the Copyright Act, 1957, and other applicable Indian and international laws.

You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Platform without Beauty Garage Limited's prior written consent.

Trademarks appearing on the Platform that are not owned by Beauty Garage Limited are the property of their respective owners and are acknowledged as such.

Disclaimers
Platform availability
The Platform and its content are provided "as is" and "as available". While we endeavour to keep information current and accurate, we do not warrant the completeness, reliability, accuracy, or uninterrupted availability of the Platform. Access may be interrupted for maintenance, upgrades, or factors outside our control.

Product and content information
Tips, routines, and guidance shared through articles, blogs, videos, or consultations on the Platform are for general informational purposes only and do not constitute medical, dermatological, or professional advice. For specific medical or scalp conditions, please consult a licensed healthcare professional. Product results may vary between individuals.

Third-party links
The Platform may contain links to third-party websites. Beauty Garage Limited does not endorse and is not responsible for the content, products, or services offered by third-party sites. Visiting linked sites is at your own risk. You may not create a link to the Platform without our prior written consent.

Limitation of Liability
To the fullest extent permitted by applicable law, Beauty Garage Limited and its directors, officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or our products, including loss of profits, data, goodwill, or business interruption, even if advised of the possibility of such damages.

In any event, Beauty Garage Limited's aggregate liability to you for any claim arising from or related to these Terms or your use of the Platform shall not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot be excluded under applicable law, including liability for fraud, death, or personal injury caused by Beauty Garage Limited's negligence.

Indemnity
You agree to indemnify, defend, and hold harmless Beauty Garage Limited and its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: your use of the Platform; your breach of these Terms; your User Content; or your violation of any applicable law or third-party rights.

Force Majeure
Beauty Garage Limited shall not be liable for any delay or failure to perform its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, civil unrest, government orders, strikes, internet outages, or failure of third-party logistics or technology providers. Beauty Garage Limited will notify you of any such event and endeavour to resume performance as soon as reasonably practicable.

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer:

If you are not satisfied with our response, you may approach the relevant consumer forum under the Consumer Protection Act, 2019, or any other authority of competent jurisdiction.

Changes to These Terms
Beauty Garage Limited may modify these Terms at any time by posting the updated version on the Platform with a revised effective date. Changes take effect upon posting. Your continued use of the Platform after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree with any change, please discontinue use of the Platform.

Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

Beauty Garage Limited and the user agree to first attempt to resolve any dispute through good-faith negotiation. If unresolved within 30 days, either party may refer the matter to the courts of competent jurisdiction in Mumbai.

General Provisions
Entire agreement: these Terms, together with all policies referenced herein, constitute the entire agreement between you and Beauty Garage Limited regarding the Platform and supersede all prior communications, representations, or agreements relating to the same subject matter.

Severability: if any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

No waiver: Beauty Garage Limited's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: you may not assign or transfer your rights or obligations under these Terms without Beauty Garage Limited's prior written consent. Beauty Garage Limited may assign its rights and obligations without restriction.

Headings: section headings are for convenience only and do not affect the interpretation of these Terms.

Language: These Terms are written in English. In the event of any conflict between an English version and any translation, the English version shall prevail.
